1. Introduction and Acceptance

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and X1-BaaS ("we", "us", or "our"), governing your access to and use of the X1-BaaS API service, including all associated endpoints, documentation, websites, and software (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

Acceptance methods: Creating an API key, making your first API request, initiating an x402 payment, sending Accept-Terms: true header, or using our websites.

2. Service Description

X1-BaaS provides web scraping, data extraction, web crawling, and browser automation via a pay-per-use API.

Payment: x402 micropayments in USDC on Base and Solana networks. Pricing: $0.005 per request.

We strive for high availability but do not guarantee uninterrupted access.

3. Permitted Use

You may use the Service to scrape publicly available web content for legitimate research, analysis, or business purposes, provided your use complies with all applicable laws.

You are solely responsible for ensuring your use complies with applicable laws and obtaining necessary permissions.

4. Prohibited Use

You may NOT use the Service to:

• Access content in violation of applicable laws
• Obtain or distribute child sexual abuse material (CSAM)
• Facilitate identity theft, fraud, or financial crimes
• Overload, disrupt, or attempt to crash target websites
• Scrape personal data without lawful basis
• Resell or redistribute the Service without authorization
• Reverse engineer or attempt to extract the Service's source code

5. Payment Terms

Current pricing: $0.005 per request via x402 micropayments (USDC on Base and Solana networks). All payments are final and non-refundable, except where required by applicable law.

6. Intellectual Property

The Service, including its software, algorithms, interfaces, documentation, and branding, is owned by X1-BaaS. You retain ownership of your Input data. Output data is provided for your use, but you are responsible for ensuring your use complies with applicable laws.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee the Service will be error-free, that scraped data will be accurate, or that the Service will meet your specific requirements.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, X1-BaaS SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER. In jurisdictions that do not allow complete exclusion, our liability is limited to $100 or the amount you paid us in the preceding 12 months, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless X1-BaaS from claims arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.

10. Termination

We may suspend or terminate your access at any time, with or without cause. You may stop using the Service at any time.

11. Dispute Resolution

These Terms are governed by the laws of Hong Kong. Disputes shall be resolved through binding arbitration administered by HKIAC.
